1. OUR CARS
The lessor delivers the vehicle to the lessee in perfect condition, with all necessary documents, tyres, tools and accessories. The renter undertakes to keep the vehicle and to drive it according to the traffic rules.
2. TERMS AND REIMBURSEMENT OF THE VEHICLE
The term of the contract is as agreed and stipulated. Nevertheless, if the renter wishes to extend the term of the contract, he must notify the lessor before the contract expires and also obtain prior consent from the lessor, subject to vehicle availability. The renter shall return the rented vehicle, together with all its documents, tyres, tools and accessories, on the date and place indicated. Failure to comply with this clause gives the lessor the authority to legally demand the return of the vehicle.
3. VEHICLE USE
The vehicle may only be driven by the lessor and persons authorized in the contract, with a maximum of one additional driver. The drivers of the vehicle must hold the valid driver's license in accordance with the characteristics of the vehicle, be over TWENTY-SIX YEARS and the driver's license must be at least two years old.
The renter must use the rented vehicle according to the following terms of use:
• No changes may be made to the structure of the rented vehicle; after all, no roof rack, luggage and/or goods may be attached to the roof.
• The vehicle must not be used to push or pull another vehicle or trailer.
• The vehicle must not be used in sporting events or training of any kind, or when testing automotive materials, accessories or products.
• The vehicle and any parts or tools thereof may not be transferred, sold, sub-rented, mortgaged or given as a pledge.
• The vehicle must not be operated under the influence of alcohol or drugs.
The vehicle may not be driven outside the territory of mainland Spain.
• The odometer may not be manipulated or unsealed and the renter must report any damage to it. Mileage is measured using the odometer or using road maps should it break down.
• The renter must stop and immobilize the vehicle if he detects a malfunction or if a warning light indicates a malfunction; they must immediately contact the lessor or his roadside assistance company.
• The rented vehicle must not be used to transport passengers or goods for commercial or industrial purposes if this is not the purpose.
4. RESERVATION
A reservation is only final once you have received a confirmation email from CostaCarAlicante. The car has currently been reserved for you. If you have not received it, please contact us.
5. PAYMENTS BY THE RENTER
The tenant undertakes to pay the landlord the agreed amount as the total rent. This price includes the amounts established for time and mileage, if applicable, contracted or non-contracted fuel, spare parts, insurance and applicable taxes. The application of the originally agreed rate is subject to the return of the vehicle at the agreed location. The renter undertakes to pay the lessor for all damage to the vehicle and costs associated with the use of the wrong type of fuel. The renter must replace any element of the vehicle that is damaged or lost for reasons attributable to him. The renter must pay the security deposit required to cover any liabilities, and in general must pay all amounts incurred by the lessor which arise directly from the use of the vehicle by the renter and which are legally attributable to them . The costs incurred by the landlord to claim any of the above payments from the tenant must be paid according to the provisions of Spanish law. The lessor reserves the right to cancel the delivery of the vehicle if it has reasonable doubts about the customer's financial standing or due to a history of non-payment or serious incidents with Costa Car Alicante.
6. MAINTENANCE AND REPAIRS
The lessor assumes normal mechanical wear and tear of the vehicle. All repairs carried out by the tenant must be approved in advance by the lessor and the relevant invoice addressed to the lessor must be submitted for reimbursement.
7. INSURANCE, ACCIDENTS AND THEFT
The renter and the authorized drivers are included in the unlimited civil liability insurance taken out by the lessor. In the event of an accident, the renter must immediately inform the lessor of any incidents and complete an accident report with all the details of the other party and any witnesses. This must be sent to the landlord. The relevant authorities must be notified if any party is injured. In the event of an accident, and as far as possible, the renter will not leave the rented vehicle without taking the necessary precautions to protect it. In case of theft, the renter must report this to the police and send a copy to the lessor. The tenant can contact Costa Car Alicante by telephone or e-mail or at the postal address of the owner.
Theft and loss of personal property, the company ”Costa Car Alicante” is not liable for stolen, damaged, forgotten or misplaced personal property in the vehicle, nor for any costs incurred as a result of damage.
In the event of a defect in the rented car due to, for example, damage, accident or a defect or malfunction of the car, Costa Car Alicante will at all times try to arrange shipping for the renter. This is only possible if Costa Car Alicante currently also has a vehicle available. If all vehicles are currently rented, it is unfortunately not possible to offer you another car. We will look together with the tenant to come to a suitable solution.
8. DAMAGES AND FINES
Damages and fines incurred during the rental period are at all times borne by the tenant. In the event of a fine, we will inform you immediately, which must then be paid the same day to our account number, including administration costs, which amount to €25 excluding VAT. Any damage to the rented vehicle will be deducted from the deposit received on site. If this damage is greater than the deposit received, it will always have to be paid by the renter to the rental company (Costacaralicante) in order to repair the damage to the vehicle.
9.CANCELLATION OF THE RENTAL AGREEMENT
It can always happen that you have to cancel the agreement, this is annoying for both parties, tenant and our company CostaCarAlicante. Since the rental company (CostaCarAlicante) has carefully reserved the car for you. After booking you have 7 days to cancel the booking free of charge, after which we will charge you 'the renter' for the reservation of the vehicle.These amounts to €25.00 administration costs excluding VAT. We (Costacaralicante) will charge cancellation costs to you 'the tenant' from one month before arrival, this amounting to € 100.00, and will always be borne by the tenant. If you cancel 'the tenant' within 20 days before the start, you will receive a maximum of 50% of the rented sum back, minus the €100.00 cancellation costs. If you cancel the car 19 days before the start or do not show up at the agreed time and location, the entire amount will be charged to you 'the renter'.
10. JURISDICTION
In the event of any dispute that may arise between the parties, they hereby agree to submit to the legally competent courts.
11. COSTS DURING THE RENTAL PERIOD
During the time that the renter has the vehicle, costs associated with the use of the vehicle such as fuel consumption, parking, making fines during the rental period, washing and cleaning are for the account of the renter. We expect our renters to treat our vehicles with respect and expect them to be returned in the same condition as delivered, including all accessories that were also present in the vehicle at that time. We expect the car to be returned to the location of delivery with a full tank of fuel! If this is not the case, we will charge extra costs (€50.-) and the costs incurred for refueling. These will be deducted from the deposit already paid.
Smoking is not allowed in our vehicles! CostaCarAlicante will charge for the costs incurres for the cleaning of the car!
12. DEPOSIT
CostaCarAlicante asks for a deposit for all our vehicles, with which we hope that our tenants will treat our cars with respect. You can transfer the deposit to us or pay it in cash when you pick up the car on location.
In the event of force majeure, the car rental company is not liable for any damage the renter may suffer as a result.
13. DATA PROTECTION
PRIVACY
Responsible : “COSTA CAR ALICANTE” Rojales (Alicante). Legitimation: Necessary for the performance of a contract and pre-contractual measures. Purposes: To provide the contracted service. Rights: access, rectification, opposition, suppression, limitation and portability. In writing to the above address accompanied by a copy of your NIF/NIE/passport. You can also submit a complaint to a supervisory authority. Recipients: Predicted sharing and/or transfers of personal data for contracting IT services for: cloud services, communication platforms and related services.
